| By purchasing your
membership for the Z-VIP program, you agree to the following terms and
conditions. The membership to the Z-VIP program entitles you to a membership
card to identify you. However, the Z-VIP card and its privileges belong to
zbone.me. Each participating club has its own list of member privileges.
These privileges can be modified or revoked at any time by the participating
clubs without notice. zbone.me and participating clubs reserve the right to
revoke the Z-VIP card or deny membership privileges at any time for misuse,
or to modify or discontinue this membership service without notice. New
participating clubs may be added at any time to the program. Existing
members are automatically enrolled to the privileges of these new
participating clubs which will be listed on zbone.me. zbone.me is
not required to notify each Z-VIP member of any changes except to post the
new information on zbone.me and by sending email via the Z-VIP mailing
list, which is an optional opt-in list. The Z-VIP card and its membership privileges are non-transferable. If your Z-VIP card is used by another person, the Z-VIP card and its privileges will be revoked. Some clubs may require valid picture ID along with the Z-VIP card. The membership privileges may not be valid for private parties, special events or promotions. The membership is valid for one year from the time of purchase (except for life time membership cards which are valid forever). Participating clubs may check the expiration date on the Z-VIP card and revoke the card or privileges if the card has expired. There is no refund once you have purchased a membership and there are no replacement Z-VIP cards if your card is lost or stolen. PRIVACY: The information provided to zbone.me for the membership (including email address) will not be sold to other parties or used by zbone.me in any other way other than for the purposes of its membership privileges. zbone.me does not obtain ANY information regarding your credit card or payment. All purchase information is kept by the online payment service on their secure server. DISCLAIMER OF WARRANTIES: YOU EXPRESSLY AGREE THAT USE OF THE CARD IS AT YOUR OWN RISK. zbone.me EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. LIMITATION OF LIABILITY: TO THE FULL EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, zbone.me SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE CARD OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH THE CARD. MISCELLANEOUS: These terms and conditions shall be governed by and construed in accordance with the laws of the state of California, excluding its conflict of law provisions. You and Z Bone agree to submit to the personal and exclusive jurisdiction of the courts located within the state of California. The failure of Z Bone to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the court should endeavor to give effect to the intention reflected in the provision, and the other provisions of these terms and conditions shall remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the card or these terms and conditions must be filed within one (1) year after such claim or cause of action arose.
